ESSE TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the ESSE website, online store, products, services, and related features.

Throughout these Terms, “ESSE,” “we,” “us,” and “our” refer to the business operating the ESSE brand and online store.

By accessing our website, placing an order, or purchasing a product, you agree to these Terms and our applicable Privacy Policy, Shipping Policy, and Return & Refund Policy.

If you do not agree to these Terms, you should not use this website or purchase products through it.

1. Online Store Use

You may use this website only for lawful purposes.

You may not:

• Use the website or services for unlawful or fraudulent purposes;

• Attempt unauthorized access to the website, accounts, payment systems, or related technology;

• Introduce malicious code, viruses, or other harmful technology;

• Interfere with website functionality;

• Misuse ESSE intellectual property; or

• Engage in conduct that violates applicable federal, state, local, or international law.

ESSE reserves the right to restrict or terminate access to the website where misuse, fraud, or unlawful activity is reasonably suspected.

2. Eligibility

By placing an order, you represent that you have legal capacity to enter into the transaction or that you are using the website with the authorization of a parent, guardian, or other person legally permitted to act on your behalf.

3. Product Information

We make reasonable efforts to accurately display product information, including:

• Product descriptions;

• Ingredients;

• Sizes;

• Packaging;

• Fragrance descriptions;

• Photographs; and

• Pricing.

However, product appearance may vary slightly due to lighting, photography, manufacturing variations, device settings, or screen displays.

Fragrance perception is subjective. Scent descriptions are intended to communicate the general fragrance profile and do not guarantee that every customer will perceive a fragrance identically.

ESSE may update product packaging, labels, presentation, or other non-material product details where appropriate.

4. Cosmetic Products and Product Use

ESSE body-care products are cosmetic products intended for external use unless expressly stated otherwise.

Product descriptions, marketing statements, educational content, and other information provided by ESSE are not intended to diagnose, treat, cure, mitigate, or prevent disease and should not be interpreted as medical advice.

Individual skin sensitivities and allergic reactions may vary.

Customers should review the full ingredient list before use, particularly if they have known allergies, sensitivities, or a history of reactions to cosmetic or fragrance products.

If you have sensitive skin or known allergies, we recommend performing a patch test on a small area of skin before broader application.

A patch test may help identify certain sensitivities but does not guarantee that an adverse reaction will not occur.

Discontinue use immediately if redness, itching, burning, swelling, rash, or another unexpected reaction occurs.

If symptoms are severe, persistent, or otherwise concerning, seek appropriate medical attention.

ESSE is not responsible for reactions resulting from use contrary to product directions, disregard of disclosed warnings, use despite a known allergy to a disclosed ingredient, or other misuse, to the extent permitted by applicable law.

Nothing in this section limits any rights or remedies that cannot legally be waived.

5. Prices and Taxes

Prices are displayed in U.S. dollars unless otherwise stated.

ESSE may change product prices at any time before an order is submitted.

Price changes do not apply retroactively to completed purchases except where necessary to correct an obvious error or where otherwise permitted or required by law.

Applicable taxes, shipping charges, discounts, and other charges will be disclosed during checkout when required.

6. Orders and Order Acceptance

Submitting an order does not automatically guarantee acceptance.

ESSE reserves the right to refuse or cancel an order where reasonably necessary, including because of:

• Product unavailability;

• Inventory errors;

• Suspected fraud;

• Payment authorization issues;

• Pricing or listing errors;

• Shipping restrictions;

• Duplicate or unusual order activity; or

• Violations of these Terms.

If ESSE cancels an order after payment has been successfully collected and merchandise has not been shipped, the applicable amount will be refunded to the original payment method.

7. Payment

You agree to provide current, complete, and accurate billing and payment information when placing an order.

Payments may be processed through third-party payment providers.

Your use of third-party payment services may also be subject to the applicable provider’s terms and privacy practices.

8. Order Cancellations

Eligible, unfulfilled orders may be canceled through ESSE’s available self-service cancellation system during the cancellation window displayed after purchase.

ESSE currently provides an automated cancellation window of 15 minutes after an eligible order is placed.

If the self-service cancellation option is available, customers may use that system to cancel the order during the applicable window.

Once the automated cancellation window has expired, cancellation is no longer guaranteed.

Customers may contact info@esseformen.com for assistance with cancellation after the automated window closes.

If an order has not entered fulfillment or shipped, ESSE may still be able to cancel it.

Once an order has entered fulfillment or has shipped, it can no longer be canceled and will instead be subject to the ESSE Return & Refund Policy.

Nothing in this section limits any cancellation right that cannot legally be waived.

9. Returns and Refunds

Eligible customers may submit a return request through ESSE’s available self-service return system within 14 calendar days of delivery.

Standard returns must comply with the eligibility requirements stated in the ESSE Return & Refund Policy.

In general, eligible returned items must be:

• Unused;

• Unopened;

• In their original condition;

• In their original packaging; and

• Associated with a valid ESSE order.

Opened, used, tested, or otherwise unsealed personal-care products are not eligible for preference-based returns due to health, hygiene, and product-integrity considerations.

This includes returns based solely on:

• Scent preference;

• Texture preference;

• Change of mind; or

• Personal preference.

Submitting a return request does not guarantee approval.

ESSE may review a return request to determine whether the product satisfies the requirements of the Return & Refund Policy.

Approved preference-based returns may require the customer to pay return-shipping costs.

ESSE does not charge a restocking fee for approved returns.

Damaged, defective, leaking, incorrect, missing, or otherwise nonconforming orders should be reported directly to:

Return and refund rights are governed by the ESSE Return & Refund Policy and applicable law.

Nothing in these Terms eliminates any consumer right or remedy that cannot legally be waived.

10. Final Sale Items

Certain products or collections may be designated as Final Sale.

Where applicable, the Final Sale designation will be disclosed before purchase.

Final Sale items are generally not eligible for preference-based returns or cancellation after the applicable cancellation window has closed.

A Final Sale designation does not eliminate any remedy required by law for products that are damaged, defective, incorrect, or otherwise nonconforming.

11. Shipping

Orders are generally processed and shipped within the timeframe stated in the ESSE Shipping Policy.

Any delivery dates or transit estimates provided at checkout, in order communications, or by a shipping carrier are estimates unless expressly identified as guaranteed.

If ESSE is unable to ship within a promised timeframe, we will provide any notice, cancellation opportunity, refund, or other remedy required under applicable law.

Customers are responsible for providing accurate and complete shipping information.

Shipping and fulfillment are governed by the ESSE Shipping Policy.

12. Promotions and Discount Codes

Promotional offers may be subject to:

• Eligibility requirements;

• Expiration dates;

• Minimum purchase amounts;

• Product exclusions;

• Usage limits; or

• Other conditions disclosed with the promotion.

Unless otherwise stated, promotional codes:

• Have no cash value;

• Cannot be redeemed for cash;

• May not be combinable with other promotions;

• May be limited to one use per customer or order; and

• May be discontinued or modified before redemption where permitted by law.

13. Intellectual Property

The ESSE name, branding, logos, product names, photographs, website content, graphics, designs, written copy, and other original materials are owned by ESSE or used under authorization.

These materials may be protected by applicable copyright, trademark, and other intellectual-property laws.

You may not copy, reproduce, republish, distribute, commercially exploit, modify, or create derivative commercial materials from ESSE content without prior written authorization, except where such use is permitted by law.

14. Reviews and User-Submitted Content

If you voluntarily submit a review, testimonial, photograph, comment, video, or other content to ESSE, you represent that you have the right to provide that material.

ESSE will not knowingly alter a customer review in a way that materially misrepresents the customer’s opinion.

Any separate permission needed to use customer photographs, videos, or identifiable content in advertising or promotional materials will be handled according to applicable law and any permissions provided.

15. Third-Party Services and Links

Our website may contain links to or integrations with third-party services, including:

• Payment processors;

• Shipping carriers;

• Analytics providers;

• Social-media platforms; and

• Other service providers.

Those third parties operate under their own terms and privacy practices.

ESSE is not responsible for third-party websites or services except to the extent responsibility cannot legally be excluded.

16. Website Availability

We do not guarantee that the website will always be available, uninterrupted, or error-free.

ESSE may temporarily suspend or restrict website access for maintenance, updates, security, technical issues, or other legitimate business reasons.

17. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and its content are provided on an “as available” basis.

Nothing in these Terms excludes any warranty, guarantee, statutory protection, or consumer right that cannot legally be excluded.

18. Limitation of Liability

To the fullest extent permitted by applicable law, ESSE will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of the website.

Nothing in these Terms limits or excludes liability where doing so would be prohibited by law.

This includes liability that cannot lawfully be waived or limited.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold ESSE harmless from claims, losses, damages, liabilities, or expenses resulting from:

• Your unlawful misuse of the website;

• Your violation of these Terms; or

• Your infringement of another person’s rights.

20. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The remaining provisions will remain in effect.

21. Changes to These Terms

ESSE may update these Terms periodically.

The “Last Updated” date at the top of this page identifies the most recent revision.

Changes will apply prospectively unless applicable law requires otherwise.

22. Governing Law

These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer-protection laws apply.
